    New Hampshire Man Charged With Gun Felony

    New Hampshire Man Arrested For Firing Gun Into Ground While Catching Suspected Burglar | Fox News

    A New Hampshire man who fired his handgun into the ground to scare an alleged burglar he caught crawling out of a neighbor's window is now facing a felony charge -- and the same potential prison sentence as the man he stopped.

    Dennis Fleming, 61, of Farmington, was arrested for reckless conduct after the Saturday incident at his 19th century farmhouse. The single grandfather had returned home to find that his home had been burglarized and spotted Joseph Hebert, 27, climbing out of a window at a neighbor's home. Fleming said he yelled "Freeze!" before firing his gun into the ground, then held Hebert at gunpoint until police arrived.
    What the hell? Man catches a burglar in the act, holds him at gun point for the police and he's thanked with a felony charge?

    Why?

    What happened to discretion?

    He should not have fired the gun! He's a jackass. The man needs some weapons training for sure. If he was confident he couldn't handle the guy, he should have had his gun ready and if the guy didn't comply he should have shot him - dead!

    A fukin' warning shot? The media can attempt to spin the story to make it seem like he was being a hero, but the reality is that he more than likely should not be carrying a gun if he's not able to manage it.

    Sure is an attention getter tho, isn't it. 27 year old and a 61 year old, better to let him live I think, but if he has to fire off a round into the dirt to make sure the guy will listen then its ok with me. Asswipe perp probably was ready to do what he was told after the big bang and glad to be alive. Don't have a problem with the one in the dirt but I don't know either of the men or the area it happened so I might be all wrong.

    I gotta side with Boston, but only if the shooter had the proper training/permits to handle the weapon.
    Whats the point in getting certifications if you cannot make decisions like this where no lives were lost.

    Had he fired the round into the air and killed someone or fired into the wall of a childs bedroom I would feel differently.

    I don't think for a second that he made a decision whether he was gonna shoot in the air or in the ground. He made a decision that he wasn't gonna shoot him... period. No training or certifications will ever teach you to fire a warning shot... there's no such thing. I never said he should have shot him for coming out of the window... he should have given him commands and if he didn't comply, then he would have had to make that decision. Sure we can monday morning quarterback the situation and say the warning shot was smart because he didn't have to shoot him. I'm just not on that bandwagon. I'm telling you that it's a different world when you're drawing down on someone. The first time I did it I'm sure I must have been shitting my pants.

    In Arizona, a person on your property (in your yard) who does not immediately comply and leave, is deemed to pose an eminent threat and deadly force can be used.     I'm going to have to side with George, kinda. The problem with what George said is that I know (at least in our City) if you shoot someone and they are not INSIDE you residence, it is murder. On the other hand warning shots are B.S. if you are going to draw on another person you had better be ready to end they're life.

    GREAT restraint...

    In the 'live free or die' state, I would say the warning shot in the dirt was probably a foot from the perps head...and, at age 61 living alone in NH and coming home to find your house ransacked? I would hafta say the old guy used "great restraint"... Any of you members who have ever been burglarized or know somebody near and dear to you that has and the cops DIDN'T catch the perp, tell me how you/they felt and then explain what you woulda done had you caught them in the act..... I rest MY case!!!
